Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the ViecTech platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ViecTech is a job marketplace platform that connects employers with job seekers, primarily focused on Vietnamese technical talent. The Service allows employers to post job listings, search for candidates, and communicate with potential hires. Job seekers can create profiles, showcase their skills, apply to jobs, and communicate with employers.

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 16 years old to create an account. Employers must have the authority to bind their organization to these Terms.

4. User Conduct

You agree not to:

• Post false, inaccurate, misleading, or fraudulent job listings
• Impersonate any person or entity
• Harass, abuse, or harm another person
• Upload viruses or malicious code
• Access or use the Service for any competitive purpose
• Collect user information without consent
• Post discriminatory job listings in violation of applicable laws
• Use automated systems to access the Service (bots, scrapers, etc.)

5. Subscription Plans and Fees

5.1 Free Plan

The Free plan includes limited features: 1 active job post, 20 applications per job, and 3-day job approval. The Free plan may be canceled or modified at any time.

5.2 Pro Plan

The Pro plan costs $99/month (or $990/year) and includes: 3 active job posts, 200 applications per job, 250 worker contacts/month, instant job approval, and full skills test access.

5.3 Premium Plan

The Premium plan costs $149/month (or $1,390/year) and includes: 10 active job posts, 200 applications per job, 500 worker contacts/month, instant job approval, featured jobs, and dedicated account manager.

5.4 Payment Terms

All fees are in USD and are non-refundable except as expressly stated in these Terms. You authorize us to charge your payment method for all applicable fees. If your payment method is declined, we may suspend your account until payment is received.

5.5 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods. All plans include a 14-day money-back guarantee for new subscribers.

6. Job Posting Rules

When posting a job on ViecTech, you agree to:

• Provide accurate and truthful job descriptions
• Specify legitimate compensation (not "unpaid" or "equity-only" unless clearly labeled)
• Comply with all applicable employment laws
• Not post jobs that require upfront payment from candidates
• Not post jobs that are illegal, fraudulent, or deceptive

We reserve the right to remove any job posting that violates these rules or is otherwise inappropriate.

7. Worker Verification

ViecTech provides verification services including ID verification, English proficiency testing (EF SET), and technical skills assessments. However, we do not guarantee the accuracy of any verification or the suitability of any candidate. Employers are responsible for conducting their own due diligence before hiring.

8. Payments Between Employers and Workers

ViecTech is not a party to any payment agreement between employers and workers. We do not process or facilitate payments between parties. Employers and workers are solely responsible for negotiating and executing their own payment arrangements. We recommend using secure payment platforms such as PayPal or Payoneer.

9. Intellectual Property

The ViecTech platform, including its code, design, logos, and content, is owned by ViecTech and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

You retain ownership of any content you post on the platform (job listings, profile information, etc.). By posting content, you grant ViecTech a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

Upon termination, we will delete or anonymize your personal information within 30 days, except where we are required to retain it for legal purposes.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THAT YOU WILL FIND A JOB OR HIRE A CANDIDATE THROUGH THE SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIECTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the liability, or $100 if you have not paid us any amounts.

13. Indemnification

You agree to indemnify and hold ViecTech harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law provisions. Any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.

16. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the changes become effective constitutes your acceptance of the modified Terms.
